Applications

What are the regulations on substances of very high concern (SVHC)?

Product:

If you are an EU supplier of articles and your product contains substances of very high concern above 0.1% w/w, you must communicate information about these substances throughout the supply chain . Upon request from a consumer, you must provide information relating to the safe use of SVHCs within 45 days. Producers and importers of EU articles must also notify the European Chemicals Agency, in case the total quantity of SVHCs in the articles exceeds 1 tonne per year.

Furthermore, manufacturers should pay particular attention to the growing number of SVHC substances listed for authorization in Annex XIV. Manufacturers who do not have an authorization to use a given substance must be aware of the latest application and expiry dates to comply with REACH requirements for the authorized use of SVHC substances.

Mixtures for consumers:
If you are a European supplier of consumer mixtures, you will be required to provide a safety data sheet if the mixture contains SVHC ≥ 0.1% w/w, upon request from downstream users or distributors. This requirement is in addition to the obligations under the Dangerous Preparations Directive 1999/45/EC and the CLP Regulation 1272/2008/EC.
